AdvanceWork – Terms of Service
Effective Date: August 10th, 2025
1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the AdvanceWork platform, including our mobile application, web platform, and related services (collectively, the “Service”).
By using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service.
2. Definitions
- “We,” “Our,” “Us” – refers to AdvanceWork LLC, the owner and operator of the Service.
- “User,” “You” – refers to the individual or organization accessing and using the Service.
- “Authorized User” – refers to any individual given access by a subscribing organization.
- “Content” – refers to all information, data, documents, images, and media uploaded or created within the Service.
3. Eligibility
You must be at least 18 years old and authorized by your organization to use the Service. By registering, you confirm that you have the legal capacity to enter into these Terms.
4. Account Registration and Security
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and restricting access to your account.
- You agree to notify us immediately of any unauthorized access or security breach.
5. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with:
- Applicable local, state, national, and international laws
- Security protocols relevant to your organization
- The intended operational purpose of executive protection management
You must not:
- Share login credentials outside your authorized team
- Attempt to reverse-engineer, hack, or disrupt the Service
- Upload malicious code, viruses, or any harmful content
6. Subscription, Fees, and Payments
- Subscription fees are billed according to your selected plan and payment schedule.
- All fees are non-refundable except where required by law or as expressly stated in your agreement.
- Late payments may result in account suspension.
7. Intellectual Property
- All intellectual property rights in the Service and its content (excluding User Content) are owned by AdvanceWork LLC or its licensors.
- You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
8. User Content
- You retain ownership of all Content you upload to the Service.
- By uploading Content, you grant us a limited, non-exclusive, worldwide license to store, process, and display it solely to provide the Service.
- You are solely responsible for ensuring your Content complies with all applicable laws.
9. Data Security and Privacy
Your use of the Service is also governed by our Privacy Policy, which outlines how we collect, store, and protect your data. We implement encryption, role-based access control, and other security measures to safeguard information.
10. Location Services
Some features require real-time location tracking. You must ensure your users are aware of and consent to location data being collected, stored, and processed for operational purposes.
11. Service Availability and Updates
- We strive to maintain 99% uptime but do not guarantee uninterrupted access.
- We may update, suspend, or discontinue parts of the Service at our discretion.
- Updates may include new features, enhancements, or security fixes.
12. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
13. Limitation of Liability
To the maximum extent permitted by law, we are not liable for:
- Loss of profits, revenue, or data
- Incidental, consequential, or indirect damages
- Operational failures caused by factors outside our control
Our total liability will not exceed the amount paid by you in the 12 months prior to the claim.
14. Termination
We may suspend or terminate your account if:
- You breach these Terms
- You fail to pay subscription fees
- Your organization requests termination
Upon termination, your access to the Service will be disabled and stored data may be deleted according to our retention policy.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of laws principles. You agree that any disputes arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
16. Changes to These Terms
We may modify these Terms at any time. Updates will be posted on our website with a revised “Effective Date.” Continued use of the Service after changes means you accept the updated Terms.
